Atlas Ready — Legal Notice

1. About This Notice

This Legal Notice applies to the Atlas Ready website, information published through the website and digital products and resources supplied by Atlas Ready.

It should be read together with the Atlas Ready Terms of Service, Privacy Policy, Return and Refund Policy, Digital Product Licence Agreement and Copyright & Intellectual Property Notice.

2. General Information

Information and resources provided by Atlas Ready are general in nature and are intended to assist organisations with matters including NDIS registration preparation, organisational documentation, implementation, compliance systems and audit preparation.

Atlas Ready information and Products are not intended to provide a complete statement of every legal, regulatory, contractual or operational requirement that may apply to a particular organisation.

Customers and Website users are responsible for considering their own circumstances and obtaining appropriate professional advice where necessary.

3. NDIS Registration and Compliance

Atlas Ready provides resources designed to assist prospective and existing NDIS providers with registration-readiness and compliance activities.

Purchasing or using an Atlas Ready Product does not guarantee:

NDIS registration;
successful Verification or Certification;
successful completion of an audit;
approval of a registration application;
approval for a particular registration group;
compliance with every NDIS Practice Standard or other requirement applicable to an organisation; or
any particular decision or outcome from an auditor, regulator or government body.

Registration, audit and compliance outcomes depend on factors including the provider's registration scope, services, workforce, risks, systems, practices, implementation, records, evidence and requirements applicable at the relevant time.

4. Customer Responsibility

Atlas Ready Products may include templates and other customisable resources.

Customers are responsible for reviewing, completing, adapting, implementing and maintaining resources so they accurately reflect their organisation.

This includes ensuring that:

organisation details are accurate;
policies and procedures reflect actual organisational practices;
roles and responsibilities are appropriately allocated;
registers, forms and records are properly used and maintained;
workers receive appropriate information and training;
organisational systems are implemented in practice; and
appropriate evidence is created and retained.

Possessing a policy, procedure, template or other document does not, by itself, demonstrate implementation or compliance.

5. Professional Advice

Atlas Ready Website content and Products do not constitute legal, accounting, financial, clinical, medical, allied health, human resources or other professional advice.

They should not be relied upon as a substitute for professional advice appropriate to an organisation's individual circumstances.

Where circumstances are specialised, complex or high-risk, appropriate professional advice should be obtained.

6. Currency of Information

NDIS requirements, legislation, rules, standards, registration requirements, regulatory guidance and expectations may change.

Atlas Ready aims to develop useful resources with reference to relevant requirements at the time of preparation. However, Atlas Ready does not guarantee that every statement, reference, template or resource will remain current indefinitely.

Customers are responsible for checking current requirements and official sources and determining whether their documentation, systems or practices require amendment.

7. Independence from the NDIS

Atlas Ready is an independent business.

Atlas Ready is not the National Disability Insurance Agency (NDIA), the NDIS Quality and Safeguards Commission, an approved quality auditor or an Australian Government agency.

Atlas Ready is not an agent or authorised representative of those organisations.

References to the NDIS, NDIS Practice Standards, registration groups, legislation, regulatory guidance or other official information do not imply endorsement, accreditation, sponsorship, authorisation or affiliation.

8. Third-Party and Official Information

Atlas Ready may refer or link to information provided by government agencies, regulators, legislation databases and other third parties.

These references and links are provided for information or convenience.

Atlas Ready does not control third-party websites and is not responsible for their availability, security, privacy practices or content except to the extent responsibility cannot lawfully be excluded.

Users should refer to relevant official sources when confirming current regulatory requirements.

9. No Guarantee of Outcomes

Atlas Ready does not guarantee that use of its Website, Products or information will result in:

successful registration or audit outcomes;
regulatory approval;
increased revenue;
reduced costs;
successful business operations; or
any other particular commercial, operational or regulatory result.

Outcomes depend on the Customer's circumstances and how resources are selected, customised, implemented, reviewed and maintained, as well as factors outside Atlas Ready's control.

10. Intellectual Property

Unless otherwise stated, Atlas Ready owns or has the right to use the intellectual property contained in its Website and Products, including original written content, templates, resource structures, graphics, branding and other original materials.

Purchasing or downloading an Atlas Ready Product does not transfer ownership of Atlas Ready's underlying intellectual property.

Customers may customise purchased Products for the internal purposes of the organisation for which they were licensed, subject to the Atlas Ready Digital Product Licence Agreement.

Atlas Ready Products must not be resold, redistributed, sublicensed, publicly uploaded or supplied to unrelated organisations for their independent use except where Atlas Ready has provided permission or the use is otherwise permitted by law.

11. Website Accuracy and Availability

Atlas Ready takes reasonable care in preparing Website content but does not warrant that all information will always be complete, current, error-free or continuously available.

Website access may occasionally be affected by maintenance, technical issues or third-party services.

If you identify information that appears inaccurate or outdated, please contact Atlas Ready so it can be reviewed.

12. Limitation of Liability

To the maximum extent permitted by law, Atlas Ready is not liable for indirect, incidental, special or consequential loss arising from reliance on general Website information or from a Customer's modification, implementation or use of an Atlas Ready Product.

To the maximum extent permitted by law, Atlas Ready is not responsible for loss arising solely from a Customer's failure to appropriately review, customise, implement, maintain or update a Product or verify current requirements applicable to its organisation.

Nothing in this Legal Notice excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

13. Copyright

Atlas Ready's Products are supplied under licence rather than through a transfer of the underlying copyright.

14. Changes to This Notice

Atlas Ready may update this Legal Notice to reflect changes to its Website, Products, business practices or applicable requirements.
